“Hedgewalk” Donation/ Art Sponsorship
The following general terms and conditions apply to donations for the purchase of young hawthorn plants or seedlings and the production of the artwork “Hedge Walk” by the artist Andy Goldsworthy on the Nieheim Art Trail.
Conclusion of contract
The contractual relationship when making a donation is between the association Freundeskreis Kulturgut Holzhausen e.V. and the sponsor.
Donations can only be made online on the website www.hedgewalk@nieheimer-kunstpfad.de.
By clicking on the field “Pay with PayPal” or “Take over a sponsorship” the donor submits an offer to the association Freundeskreis Kulturgut Holzhausen e.V. to conclude the contract. The acceptance of the offer is made by payment and confirmation of this payment by PayPal or receipt of payment after transfer in case of taking over a sponsorship to the account of the association Freundeskreis Kulturgut Holzhausen e.V.. The donation is thereby binding.
Subject of the contract
The association Freundeskreis Kulturgut Holzhausen e.V. makes it possible for potential donors to donate money for the purchase of young hawthorn plants or seedlings and the production of the artwork “Hedge Walk” by or based on the planning of the English artist Andy Goldsworthy on the Nieheim Art Trail, thus promoting art and nature in the Nieheim area in equal measure.
As a donation amount a minimum of € 200,00 per plant is intended. This amount covers both the purchase of a plant and the pro rata production of the artwork “Hedge Walk” for one plant.
In addition, a freely selectable donation amount is possible.
The “Hedge Walk” is currently planned for a length of approx. 180 m with approx. 1100 plants. The location of the Hedge Walk is to be the Mühlenknapp field owned by Baron von der Borch, Holzhausen district, plot 7, parcel 39/22.
The individual plants of the “Hedge Walk” will be numbered consecutively. Potential donors therefore have the possibility to take over a sponsorship for single or several plants of the Hedge Walk with their donation. This sponsorship is completed by sending the form “Take over a sponsorship”. In this case, the donor will receive a certificate indicating the plant numbers, year of planting, type of plant, planting location, and coordinates. The certificate will be sent to the donor within 30 days after receipt of payment by e-mail or, alternatively, against payment of the postage costs additionally by mail. In addition the donor has with assumption of a sponsorship the possibility of giving an agreement for the denomination of the name on the Websites of the friend circle cultural property Holzhausen registered association www.kulturgut-holzhausen.de, the Nieheimer art path on www.hedgewalk@nieheimer-kunstpfad.de and/or www.nieheimer-kunstpfad.de.
The donation is earmarked for the artwork “Hedge Walk” and is a voluntary gift without consideration.
The donation campaign starts on 16.06.2023. The term is initially indefinite. The planting and thus the production of the “Hedge Walk” will take place from approx. 20.10.2023 and can be visited at any time.
Payment
Donations are [not] subject to sales tax, a sales tax is therefore [not] incurred. When donating online, payment is made by the donor via PayPal account, credit card, direct debit or purchase on account [examples].
Donation receipt/gift voucher
The association Freundeskreis Kulturgut Holzhausen e.V. will automatically issue a donation receipt to the donor for donations over € 200.00, which will be sent after receipt of the donation.
Cancellations
Cancellation of the donation is not possible.
Liability / Binding
If the association Freundeskreis Kulturgut Holzhausen e.V. culpably violates an essential contractual obligation or if the damage claimed by the donor is based on intent or gross negligence, including intent or gross negligence of the representatives or vicarious agents of the association Freundeskreis Kulturgut Holzhausen e.V., the association Freundeskreis Kulturgut Holzhausen e.V. is liable according to the legal regulations.
The association Freundeskreis Kulturgut Holzhausen e.V. assures to use the donations provided exclusively for the acquisition of young hawthorn plants or saplings as well as for the production of the artwork “Hedge Walk” on the Nieheim Art Trail.
Each plant acquired through a donation becomes part of the Hedge Walk artwork and may not be removed. The association Freundeskreis Kulturgut Holzhausen e.V. does not guarantee that the plants will grow. The association Freundeskreis Kulturgut Holzhausen e.V. will make every effort to replace plants that do not grow or later die as quickly as possible. There is no claim for repayment of the donation.
The association Freundeskreis Kulturgut Holzhausen e.V. will erect an information board, which will inform in a general way about the commitment of the donors (no individual naming).
Should more donations be received than are needed for the “Hedge Walk”, these will be used for the preservation of the artworks or new artworks of the Nieheim Art Trail in order to realize the statutory, tax-privileged purposes of the association Freundeskreis Kulturgut Holzhausen e.V..

For the processing of the contractual relationship for online donations, name and account information will be stored at the service provider PayPal for the duration of the contractual relationship with the service provider PayPal.
If a donation receipt or gift voucher is requested, the name, telephone number and e-mail address of the donor will be stored and used by the association Freundeskreis Kulturgut Holzhausen e.V. in accordance with the provisions of the EU General Data Protection Regulation of May 25, 2018. The data collected during an online donation will be used for the administration and acknowledgement of the donation, as well as for information about donation campaigns. Donation data is stored for ten years in accordance with legal requirements.
Employees of the association Freundeskreis Kulturgut Holzhausen e.V. who are involved in the processing of the contractual relationship have access to this data exclusively for the purpose of processing the contract.
Final clauses
The association Freundeskreis Kulturgut Holzhausen e.V. reserves the right to change these conditions at any time without giving reasons. Such changes do not apply to donations that have already been made.
Should individual provisions be or become void or ineffective, this shall not affect the validity of the remainder of the contract.
The law of the Federal Republic of Germany shall apply exclusively. The sole place of performance for delivery, service and payment is Nieheim.
